Judge Rules Health Care Law Is Unconstitutional

A U.S. district judge on Monday threw out the nation's health care law, declaring it unconstitutional because it violates the Commerce Clause and surely reviving a feud among competing philosophies about the role of government.
Judge Roger Vinson, in Pensacola, Fla., ruled that as a result of the unconstitutionality of the "individual mandate" that requires people to buy insurance, the entire law must be declared void.

He struck down a "key part" of the bill. Not the entire bill.

Until this gets to the SCOTUS, the whole matter is drivel. Now, if those good folks did strike down this 'key part' of the law, folks would slap their heads in amazement at how much their insurance costs shot up, but not a problem, right? :roll:

Oh hell, that will be thrown out at the circuit court level. Nothing in his decision justified voiding the entire law, just the mandatory purchase requirement.

I suppose the would depend on exactly HOW the law was written. it "could" justify voiding it completely OR or could just invalidate that one clause in the law.

This will obviously be appealed and end up in the SCOTUS several years down the road.

actually, Slick has very good, and very expensive health insurance. Remember, laddie, I can afford it and always will be able to. What Slick wants is cradle-to-grave Medicare, and those that want more coverage pay for it out of their own monies.

actually, CUDA, the one positive out of this ruling is that it should hasten the path to the SC. I figure it will be on the 2012 docket.
