This argument has been around forever.
I remember this being prominent in WA state in 1993 or 1994.
Good luck trying to claim you're not a citizen of the US, but rather a citizen the sovereign state of (whatever).
And Good luck getting your employer to accept a W8 form and opting out of witholding.

I thought it interesting that a "former" Judge wrote the opinion piece.
Having read/heard this Judge before...I ain't particularly impressed with
his judicial savvy.
