ok. both. thats what makes it such a difficult issue to tackle, the proverbial "gray area"

plus it is international, and dealing with international documents and laws, which further complicates matters

i think, for example, the sarah palin email hack was brilliant, for its results...but the means taken to get them, hacking, invading her privacy, is intolerable

I'm leaning more towards Receiving stolen property. they have obviously received documents that were not for general consumption since most were classified. and since Wiki is just a blog and is not an acredited news agency I cannot see this being a freedom of the press issue. also it would be hard to head towards Treason as this is an international issue (WWW) and what nation(s) was it treasoness against??

another question How do you prosecute???

Cuda, the soldier in this matter is being charged with Treason. Depending on where WikiLeaks is located? They could be charged with the same.

Oh yes, to answer the thread question, it's both. But the man providing the stolen information deserves a firing squad.

I had not heard this. if true then I say execution by firing squad would seem to be the appropraite punishment, then we can post the video on WikiLeaks.

Wikileaks purports to support 'transparency' in corporate and government practice. In reality, due to the unverifiable nature of the material in many cases, they are yet another Internet site with an agenda. In many cases, yes, they are receiving and disseminating stolen property. Lots of luck prosecuting them, however.
I've heard they plan to centralize servers in Iceland, which is considering very liberal laws protecting freedom of online information dissemination.

As for the case that has gotten them into the news today: The source of the material should be found guilty of treason or similar. However, it does give insight into exactly what sort of dicey mess we've gotten into over there, and maybe, will give the public some reasons(as if they should have needed them) to wonder if we are spending 1/2 trillion per year wisely over in Afghanistan.
